Briefing: Impact of Section 301 Tariffs on Forced Labor Enforcement

Description:

The U.S. Government is now looking to more traditional trade authorities such as Section 301 to rebuild broad tariff coverage after the Supreme Court invalidated the novel IEEPA tariffs.  In doing so, the U.S. Government has placed the enforcement of forced labor import prohibitions at home and abroad in the spotlight.  These actions may lead some U.S. trading partners to adopt or enhance such laws in their jurisdictions.  At the same time, a week after the tariffs went into effect, the U.S. Government announced its first additions to the Uyghur Forced Labor Prevention Act (UFLPA) Entity List under the second Trump administration, signaling a potential renewed focus on that forced labor enforcement mechanism.  In this briefing, we will provide an update on the status of Section 301 forced labor tariffs and pending legal challenges, consider how these tariffs may impact forced labor enforcement more broadly, and discuss strategies for compliance.
